Have you been charged with a crime?
Being charged with a crime can be one of the most devastating things that you will ever experience. Your freedom is at stake. You could be looking at years in prison or months in jail. Not only is your freedom at stake, but you could also lose your family, your job, your cars and other assets, as well as your reputation.
Fortunately, you are guaranteed certain rights under both the United States and West Virginia Constitutions. Among those, and perhaps the most important, is the right to an attorney. The proper attorney can make the difference between spending years in prison and being found not guilty.
The lawyers at Harvey & Janutolo Law Offices have represented hundreds of people who have been charged with a crime. This includes people charged with murder, rape, kidnapping, malicious assault, battery, robbery, grand larceny, burglary, auto theft, insurance fraud, DUI, and drug crimes, as well as an assortment of other charges.
The lawyers at Harvey & Janutolo Law Offices are not afraid to go to trial. Put simply, we are highly experienced in representing defendants in jury trials, and have the ability to handle all the intricate details involved.
However, there are situations or circumstances where a trial is not in a defendant’s best interest. In those cases, with the client’s permission, negotiating a plea bargain may be the best way to proceed. The attorneys at Harvey & Janutolo Law Offices are highly experienced and very skilled at negotiating pleas with prosecutors; pleas which have saved clients from serving an untold number of years in jail or prison.
If you have been charged with a crime, or think you may be, you need an experienced lawyer.
Some Important Suggestions:
If you are suspect in a crime or have been arrested—
-Be respectful and polite to all law enforcement officers.
-Do not give a statement. Tell the officer that you want to exercise your 5th Amendment right to remain silent.
-Insist on calling your lawyer. Do not ask the officer if he thinks you need a lawyer. Be clear. Say “ I want a lawyer.”
- Never consent to a search. Always ask the officer if he has a search warrant. If not, insist that he obtain one.
These suggestions are obviously just recommendations and exercising them will not protect all your rights. For that you will need an attorney.
